IMPORTANT NOTICE
THIS AGREEMENT APPLIES TO THE DIY LITE SUBSCRIPTION SERVICE ONLY.
BY PURCHASING THIS SERVICE, YOU AGREE TO BE BOUND BY BOTH THIS SERVICE AGREEMENT AND THE GENERAL TERMS OF SERVICE AVAILABLE AT WWW.OZPATH.AU/APPTERMS
2. PRICING AND PAYMENT
2.1 Subscription Fee
The Agent Chat subscription fee is $29.99 AUD (excluding GST if applicable) for 1 month of access.
2.2 Payment Processing
All payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms and conditions.
2.3 No Auto-Renewal
Your Agent Chat subscription will not automatically renew at the end of the 1-month period. If you wish to continue accessing migration agent chat services after your subscription expires, you must:
- (a) Contact us at contact@ozpath.au to discuss renewal options; or
- (b) Purchase a new subscription through the Application
2.4 Government Fees
The subscription fee does not include any government visa application fees, which remain your sole responsibility.
3. REFUND POLICY
3.1 Eligibility for Refund
You are eligible for a full refund of your subscription fee only if:
- (a) You have not initiated any chat conversation with a migration agent; and
- (b) You request the refund in writing to contact@ozpath.au
3.2 No Refund After Agent Contact
Once you have sent your first message to a migration agent through the Agent Chat service, you are no longer eligible for any refund, regardless of:
- (a) Whether the agent has responded to your message
- (b) The quality or timeliness of the agent's response
- (c) How much time remains in your 3-month subscription period
- (d) Your satisfaction with the service
3.3 Refund Processing Time
If you are eligible for a refund, it will be processed within 10 business days of your refund request. Refunds will be issued to the original payment method used for purchase.
3.4 Australian Consumer Law
Nothing in this refund policy limits or excludes any rights, guarantees, or remedies you may have under the Australian Consumer Law that cannot be lawfully excluded.
4. UPGRADE TO FULL LODGEMENT SERVICE
4.1 Upgrade Option
As a Agent Chat subscriber, you may upgrade to the Full Lodgement Service at any time during your subscription period for $670.99 AUD (instead of the standard $689.00 AUD).
4.2 Fixed Upgrade Price
The upgrade price of $670.99 AUD is fixed and applies regardless of:
- (a) When you choose to upgrade during your 1-month subscription period
- (b) How much time remains on your Agent Chat subscription
- (c) How many times you have contacted the migration agent
4.3 Separate Agreement Required
Upon upgrading to Full Lodgement Service, you will be required to review and accept a separate Full Lodgement Service Agreement, which will govern:
- (a) The terms and conditions of the Full Lodgement Service
- (b) How any remaining time on your Agent Chat subscription will be treated
- (c) Additional services and inclusions specific to Full Lodgement
- (d) Refund and cancellation terms for the upgraded service
4.4 No Refund of Agent Chat Fee Upon Upgrade
Your original Agent Chat subscription fee of $29.99 AUD is non-refundable upon upgrading to Full Lodgement Service.
5. CANCELLATION AND ACCOUNT DELETION
5.1 Cancellation by Account Deletion
You may cancel your Agent Chat subscription at any time by deleting your OzPath account through the Application settings.
5.2 No Refund Upon Cancellation
If you cancel your subscription by deleting your account:
- (a) You will not receive any refund of your subscription fee, regardless of how much time remains in your 3-month period
- (b) Your access to migration agent chat will cease immediately
- (c) You will retain access to free features of the Application (OzPal chatbot, news, calculators) if you create a new free account
- (d) All your chat history and data will be deleted in accordance with our Privacy Policy
5.3 Cancellation by OZPATH PTY LTD
OZPATH PTY LTD reserves the right to suspend or terminate your Agent Chat subscription immediately if:
- (a) You breach any provision of this Agreement or the General Terms of Service
- (b) You engage in abusive, harassing, or inappropriate conduct toward migration agents
- (c) You misuse the service or attempt to circumvent service limitations
- (d) Providing services to you is no longer commercially viable or legally permissible
In such cases, OZPATH PTY LTD may, at its sole discretion, provide a pro-rata refund for any unused portion of your subscription.
6. MIGRATION AGENT SERVICES
6.1 Registered Migration Agents
All migration agents accessible through the Agent Chat service are registered with the Office of the Migration Agents Registration Authority (OMARA) and bound by the Migration Agents Code of Conduct.
6.2 Scope of Agent Assistance
Migration agents will provide general guidance and information regarding 485 visa applications. However:
- (a) Agents are not required to provide comprehensive case assessments through Agent Chat chat
- (b) Agents will not review, check, or verify your documents under this service tier
- (c) Agents will not lodge visa applications on your behalf
- (d) Agents may refer you to upgrade to Full Lodgement Service for more comprehensive assistance
- (e) Agents reserve the right to decline inquiries outside the scope of 485 visa matters
6.3 No Guarantee of Outcomes
OZPATH PTY LTD and the migration agents make no representations or warranties regarding:
- (a) The success of any visa application
- (b) The accuracy or completeness of information provided through chat
- (c) The suitability of any advice or guidance for your specific circumstances
- (d) Any particular timeline for visa processing or outcomes
6.4 Your Responsibility
You acknowledge and agree that:
- (a) You are ultimately responsible for your visa application and all decisions related to it
- (b) You must verify all information provided by agents through official government sources
- (c) You should seek independent professional advice if you have complex circumstances
- (d) The Agent Chat service is designed for users who wish to manage their own visa application with limited guidance
7. DATA SHARING WITH MIGRATION AGENTS
7.1 Consent to Share Information
By purchasing the Agent Chat subscription, you explicitly consent to OZPATH PTY LTD sharing the following information with contracted migration agents:
- (a) Your account information and contact details
- (b) Your visa stream selection and preliminary questionnaire responses
- (c) Your chat history and messages with the migration agent
- (d) Any documents you choose to upload or share during chat conversations
- (e) Your progress tracking and checklist data
7.2 Agent Confidentiality
All migration agents are bound by:
- (a) Professional confidentiality obligations under the Migration Agents Code of Conduct
- (b) Contractual confidentiality obligations with OZPATH PTY LTD
- (c) Australian privacy laws and regulations
7.3 Data Retention
Your chat history and related data will be retained in accordance with our Privacy Policy available at www.ozpath.au/appprivacy.
8. DISCLAIMERS AND LIMITATIONS OF LIABILITY
8.1 Service Availability
While OZPATH PTY LTD will make reasonable efforts to ensure service availability:
- (a) We do not guarantee uninterrupted access to migration agent chat services
- (b) Agent availability may vary due to workload, leave, or other circumstances
- (c) Technical issues may occasionally affect service delivery
- (d) Response times of 24-48 hours are targets, not guarantees
8.2 No Guarantee of Visa Success
OZPATH PTY LTD expressly disclaims all liability for:
- (a) The outcome of any visa application
- (b) Any visa refusal, cancellation, or adverse immigration decision
- (c) Delays in visa processing by the Department of Home Affairs
- (d) Any financial loss, travel disruption, or other consequential damages arising from visa outcomes
8.3 Limitation of Liability
To the maximum extent permitted by law, OZPATH PTY LTD's total liability for any claims arising from the Agent Chat service shall not exceed $29.99 AUD (the amount you paid for the subscription).
8.4 Exclusion of Consequential Damages
To the maximum extent permitted by law, OZPATH PTY LTD shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to:
- (a) Loss of visa application fees paid to the government
- (b) Travel expenses or cancelled travel plans
- (c) Loss of employment or educational opportunities
- (d) Emotional distress or reputational damage
- (e) Any other losses not directly caused by our breach of this Agreement
8.5 Australian Consumer Law
Nothing in this Agreement limits or excludes any rights, guarantees, or remedies you may have under the Australian Consumer Law or other mandatory consumer protection laws that cannot be lawfully excluded.
9. YOUR OBLIGATIONS
9.1 Accurate Information
You must provide accurate, complete, and truthful information to migration agents. Providing false or misleading information may:
- (a) Result in incorrect advice or guidance
- (b) Jeopardise your visa application
- (c) Constitute a breach of Australian immigration law
- (d) Result in immediate termination of your subscription without refund
9.2 Respectful Communication
You must communicate with migration agents in a respectful and professional manner. The following conduct is strictly prohibited:
- (a) Abusive, threatening, or harassing language
- (b) Discriminatory or offensive remarks
- (c) Excessive or unreasonable demands
- (d) Spam or repetitive messages
Violation of this provision may result in immediate termination of your subscription without refund.
9.3 Compliance with Laws
You must comply with all applicable Australian immigration laws and regulations. You acknowledge that:
- (a) The Agent Chat service does not authorise you to remain in Australia beyond your current visa conditions
- (b) You are responsible for ensuring you hold a valid visa at all times
- (c) You must lodge any visa applications within required timeframes
- (d) OZPATH PTY LTD is not responsible for any immigration breaches or unlawful presence
9.4 Scope Limitations
You acknowledge and agree that:
- (a) The Agent Chat service is limited to 485 visa inquiries only
- (b) Agents may decline to answer questions outside this scope
- (c) You should not expect comprehensive case management or document review
- (d) For more comprehensive services, you should upgrade to Full Lodgement Service
10. INTELLECTUAL PROPERTY
10.1 OzPath Ownership
All intellectual property rights in the OzPath Application, including the Agent Chat service features, remain the exclusive property of OZPATH PTY LTD.
10.2 Limited License
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Agent Chat service for personal, non-commercial purposes only during your subscription period.
10.3 Restrictions
You may not:
- (a) Copy, reproduce, or distribute any content from migration agent chats
- (b) Use information provided by agents for commercial purposes
- (c) Share your account access with others
- (d) Reverse engineer or attempt to extract source code from the Application
11. GENERAL TERMS
11.1 Relationship to General Terms of Service
This Agent Chat Service Agreement is supplementary to and must be read in conjunction with the OzPath General Terms of Service available at www.ozpath.au/appterms. In the event of any conflict between this Agreement and the General Terms of Service, this Agreement shall prevail to the extent of the inconsistency.
11.2 Amendments
OZPATH PTY LTD reserves the right to modify this Agreement at any time:
- For material changes, you will receive email notification at least 30 days before changes take effect
- Continued use of the service after the notice period constitutes acceptance of the modified terms
- If you do not agree to the changes, you may cancel your subscription in accordance with Section 5
- Changes will not affect subscriptions already purchased unless required by law
11.3 Dispute Resolution
Any disputes arising from this Agreement shall be resolved in accordance with the dispute resolution process set out in Section 13 of the General Terms of Service.
11.4 Governing Law
This Agreement is governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of New South Wales.
11.5 Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
11.6 Entire Agreement
This Agreement, together with the General Terms of Service and Privacy Policy, constitutes the entire agreement between you and OZPATH PTY LTD regarding the Agent Chat service and supersedes all prior agreements or understandings.
11.7 Waiver
No waiver of any provision of this Agreement shall constitute a waiver of any other provision or subsequent breach. OZPATH PTY LTD's failure to enforce any right shall not constitute a waiver of that right.
11.8 Assignment
You may not assign or transfer this Agreement or your subscription without OZPATH PTY LTD's prior written consent. OZPATH PTY LTD may freely assign this Agreement without restriction.
