- (h) Access to paid subscription services including migration agent assistance (subject to separate Service Terms)
1.2 Agreement to Terms
By creating an account, accessing, or using OzPath, you acknowledge that you have read, understood, and agree to be bound by these General Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Application.
1.3 Service Tiers
OzPath offers both free and paid subscription tiers. While these Terms apply to all users, additional Service Terms will apply when you purchase a paid subscription. You will be required to review and accept the relevant Service Terms at the point of purchase, which will detail:

- (ii) Updated Terms will be available within the Application
- (iii) Continued use after the 30-day notice period constitutes acceptance
- (iv) If you do not agree, you must cease using the Application and may delete your account

1.5 Eligibility

2. GOVERNMENT NON-AFFILIATION
OZPATH PTY LTD is not affiliated with, endorsed by, or connected to the Department of Home Affairs or any Australian government department or agency. OzPath is an independent service providing information and tools only. All official immigration matters must be conducted through appropriate government channels or with registered migration agents.
3. ACCOUNT REGISTRATION
3.1 Creating an Account
To access OzPath services, you must register for an account. During registration, you may be required to provide:

- (b) Password
- (c) Visa stream selection
- (d) Preliminary questionnaire responses
- (e) Other information as requested
3.2 Account Information Accuracy
You warrant that all information provided during registration and throughout your use of the Application is accurate, current, and complete. You agree to update your information promptly if it changes.

- (e) Notification preferences and scheduled reminders
- (f) Checklist completion status and progress tracking
- (g) Document classification and translation requirements (temporarily, during processing)
4.2 Information We Do NOT Store
OzPath does not store:
- (a) Payment or financial information (processed securely by third-party payment provider)
- (b) Permanent copies of uploaded documents beyond processing requirements
- (c) Biometric data
- (d) Government identification documents (beyond temporary processing)
4.3 Third-Party Processing
- (a) Your data may be processed by:
- (b) Firebase for authentication services
- (c) External AI services for chatbot functionality
- (d) Stripe for payment processing
- (e) Analytics providers for service improvement and diagnostics
- (f) Translation service providers for document translation (temporary access only)
- (g) Contracted migration agents (for paid subscribers only) who may access your chat history, questionnaire responses, and uploaded documents as necessary to provide services
4.4 Sharing with Migration Agents
For users who subscribe to paid tiers that include migration agent assistance:

- (c) Chat history and interaction logs
- (d) Uploaded documents and translations
- (e) Progress tracking and checklist data with contracted migration agents for the purpose of delivering the subscribed services.
- (f) Migration agents are bound by confidentiality obligations and professional standards under Australian law.
4.5 Data Retention and Deletion
- (a) Chat histories are retained according to service operational limits
- (b) Limited offline functionality and data access may be available
- (c) You may request deletion of your data by deleting your account (see Section 11)
- (d) Upon account deletion, your personal data will be deleted within a reasonable timeframe, subject to legal retention requirements

- (c) Engage in any commercial activity through the Application without express authorisation

- (f) Upload or transmit viruses, malware, or other harmful code
- (g) Interfere with or disrupt the Application's operation or servers
- (h) Misrepresent your identity or affiliation with any person or entity
- (i) Post or transmit any content that is unlawful, defamatory, harassing, abusive, or otherwise objectionable
5.4 Commercial Solicitation
Unsolicited commercial advertisements, affiliate links, and other forms of solicitation may be removed without notice and may result in termination of your account. OZPATH PTY LTD reserves the right to take legal action for any illegal or unauthorised use of the Application.
6. OZPAL AI CHATBOT
6.1 Purpose of OzPal
OzPal is an AI-powered chatbot designed to provide general information only about Australian visa processes and requirements.
6.2 Not Legal or Migration Advice
IMPORTANT: OzPal does not provide immigration advice, legal advice, or professional migration assistance. Information provided by OzPal:
- (a) Is for general guidance and educational purposes only
- (b) Should not be relied upon for making critical immigration decisions
- (c) May be incomplete, incorrect, or outdated
- (d) Is generated automatically and not reviewed by immigration professionals
6.3 User Responsibility
You must:
- (a) Verify all information provided by OzPal through official government channels
- (b) Consult a registered migration agent or immigration lawyer for advice specific to your circumstances
- (c) Not rely solely on OzPal for visa application decisions
6.4 Limitations and Disclaimers
OZPATH PTY LTD makes no representations or warranties regarding:
- (a) The accuracy, completeness, or currency of OzPal's responses
- (b) The suitability of OzPal's information for your specific situation
- (c) The reliability or availability of OzPal services
7. PAYMENT AND SUBSCRIPTIONS
7.1 Payment Processing
All payments for OzPath paid subscriptions are processed securely through Stripe. By making a payment, you agree to be bound by Stripe's terms and conditions available at their website.
7.2 Payment Responsibility
You are responsible for:
- (a) Ensuring your payment method is valid and has sufficient funds
- (b) Any costs, fees, or charges (including banking fees) associated with failed, returned, or denied payments
- (c) Reviewing and accepting the applicable Service Terms for your chosen subscription tier
7.3 Service Fees
OZPATH PTY LTD reserves the right to vary subscription pricing at any time. Existing subscribers will be notified of price changes in accordance with their Service Terms.
7.4 Refunds
Refund terms are specific to each subscription tier and are detailed in the applicable Service Terms you accept at the time of purchase. Nothing in these Terms limits your rights under the Australian Consumer Law.
8. INTELLECTUAL PROPERTY
8.1 OzPath Ownership
The Application, its content, design, features, and all related intellectual property (including but not limited to text, graphics, logos, software, code, and trademarks) are owned by or licensed to OZPATH PTY LTD and protected by Australian and international copyright and intellectual property laws.
8.2 Limited License to Users
OZPATH PTY LTD grants you a limited, non-exclusive, non-transferable, revocable license to:
- (a) Access and use the Application for personal, non-commercial purposes
- (b) Cache the Application in your device's memory as necessary for operation

8.3 Restrictions

- (b) Transmit documents to contracted migration agents (for paid subscribers) and translators
- (c) Use documents for quality assurance and service improvement (in de-identified form)
- (d) This license terminates upon completion of the relevant service or deletion of your account.
9. DISCLAIMERS AND LIMITATION OF LIABILITY
9.1 Australian Consumer Law
Nothing in these Terms limits or excludes any rights, guarantees, or remedies you may have under the Australian Consumer Law or other mandatory consumer protection laws that cannot be lawfully excluded.
9.2 General Disclaimers
Subject to the above, and to the maximum extent permitted by law:
- (a) The Application and all services are provided "as is" and "as available" without any warranties of any
- (b) kind, whether express or implied
- (c) OZPATH PTY LTD does not warrant that the Application will be uninterrupted, error-free, secure, or free
- (d) from viruses or harmful components
- (e) OZPATH PTY LTD does not guarantee any specific outcome from using the Application, including visa
- (f) application success
9.3 No Immigration Advice Guarantee
OZPATH PTY LTD expressly disclaims all liability for:
- (a) Any decisions you make based on information obtained through the Application (including from OzPal or
- (b) migration agents)
- (c) Inaccuracies, errors, or omissions in information provided
- (d) Any loss, damage, or adverse consequences arising from your reliance on Application content
- (e) The outcomes of any visa application or immigration matter
You acknowledge and agree that:
- (f) OzPath is an informational and facilitation tool only
- (g) Use of OzPath does not guarantee any visa outcome
- (h) You are solely responsible for your immigration decisions
- (i) You should obtain independent professional advice for your specific circumstances
9.4 AI-Generated Content Disclaimer
Information generated by OzPal or other AI features:
- (a) May contain inaccuracies, errors, or be incomplete or outdated
- (b) Should not be relied upon as professional advice
- (c) Must be independently verified through official sources
- (d) Is provided without any guarantee of accuracy or suitability
9.5 Third-Party Services
OZPATH PTY LTD is not responsible for:
- (a) The operation, reliability, or availability of third-party services (including Stripe, Firebase, AI providers, or translation services)
- (b) Any acts or omissions of third-party service providers
- (c) The performance or conduct of migration agents contracted through OzPath (although we require agents to
- (d) maintain professional standards)
9.6 Limitation of Liability
To the maximum extent permitted by law, OZPATH PTY LTD's total liability for any claims arising from or related to your use of OzPath, whether in contract, tort (including negligence), statute, or otherwise, shall not exceed:
- (a) For free users: $100 AUD
- (b) For paid subscribers: the amount you paid for services in the 12 months preceding the claim
9.7 Exclusion of Consequential Damages
To the maximum extent permitted by law, OZPATH PTY LTD shall not be liable for any:
- (a) Indirect, incidental, special, consequential, or exemplary damages
- (b) Loss of profits, revenue, business opportunities, goodwill, or data
- (c) Costs of substitute services or products
- (d) Visa refusal, cancellation, or adverse immigration outcomes
This exclusion applies regardless of whether OZPATH PTY LTD was advised of the possibility of such damages.
9.8 Your Responsibility
You acknowledge that:
- (a) You use OzPath entirely at your own risk
- (b) You are responsible for evaluating the accuracy and reliability of all information
- (c) You should take all necessary precautions, including backing up important data and documents
- (d) You must comply with all applicable immigration laws and requirements
11. ACCOUNT TERMINATION
11.1 Termination by You
You may terminate your account at any time by deleting your account through the Application settings. If you have an active paid subscription, termination terms (including any applicable refunds) will be governed by your Service Terms.
11.2 Termination by OZPATH PTY LTD
OZPATH PTY LTD may suspend or terminate your account immediately, without prior notice, if:
- (a) You breach any provision of these Terms or applicable Service Terms
- (b) You engage in fraudulent, illegal, or unauthorised activity
- (c) OZPATH PTY LTD is required to do so by law or court order
- (d) Your conduct damages OZPATH PTY LTD's reputation or violates the rights of others
- (e) Providing services to you is no longer commercially viable or feasible
11.3 Effect of Termination
Upon termination:
- (a) Your right to access and use OzPath will cease immediately
- (b) You will no longer have access to your account, data, or chat history
- (c) Any outstanding payment obligations remain due
- (d) OZPATH PTY LTD may delete your data in accordance with our Privacy Policy and data retention obligations
- (e) Provisions of these Terms that by their nature should survive termination (including disclaimers, limitation of
- (f) liability, indemnification, and dispute resolution) will continue to apply.
12. COMPETITOR USE PROHIBITION
If you are in the business of providing similar services to OzPath for commercial gain (whether to business or individual users), you are considered a competitor and are prohibited from using or accessing the Application or any of its content.
If you breach this provision, OZPATH PTY LTD will hold you fully responsible for any losses sustained and accountable for any profits derived from such breach.
13. DISPUTE RESOLUTION
13.1 Compulsory Process
Before commencing any legal proceedings (except where urgent interlocutory relief is required), the parties must follow this dispute resolution process.
13.2 Notice of Dispute
A party claiming a dispute must provide written notice to the other party detailing:
- (a) The nature of the dispute
- (b) The desired outcome
- (c) The action required to settle the dispute
13.3 Negotiation and Mediation
Upon receipt of a dispute notice:
The parties must endeavor in good faith to resolve the dispute within 28 days through negotiation or other mutually agreed means
If the dispute is not resolved within 28 days, the parties must either:
- (a) Agree on a mediator; or
- (b) Request appointment of a mediator by the Australian Mediation Association
13.4 Mediation Terms
- (a) Both parties are equally liable for the mediator's fees and reasonable expenses
- (b) Each party bears its own costs associated with the mediation
- (c) Mediation will be held in Sydney, Australia
- (d) All communications during mediation are confidential and treated as "without prejudice"
13.5 Termination of Mediation
If the dispute remains unresolved 2 months after the start of mediation, either party may request the mediator to terminate the mediation process.
15. GENERAL PROVISIONS
15.1 Entire Agreement
These Terms, together with any applicable Service Terms, Privacy Policy, and other policies referenced herein, constitute the entire agreement between you and OZPATH PTY LTD regarding your use of OzPath.
15.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
15.3 Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. OZPATH PTY LTD's failure to enforce any right or provision shall not constitute a waiver of that right or provision.
15.4 Assignment
You may not assign or transfer these Terms or any rights granted hereunder without OZPATH PTY LTD's prior written consent. OZPATH PTY LTD may freely assign these Terms without restriction.
15.5 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and OZPATH PTY LTD.
